    The website https://scholarsedge.co.in and all its associated subdomains (collectively referred to as the "Site") are owned, managed, and operated by ScholarsEdge ("Company", "us", "we", or "our"). The Company is engaged in the business of operating an advanced online educational ecosystem, organizing scholarship examination programs, providing browser-based AI-proctored testing environments, and managing student merit analytics to facilitate fair academic evaluations for students ("Services").

    This Terms & Conditions document, alongside our Privacy Policy, Cookies Policy, and any event-specific registration guidelines, constitutes a legally binding contractual agreement ("Agreement") between the Company and the User ("you", "your", or "User").

    Please read this Agreement carefully before registering for an account, subscribing to any mock tests, or participating in a live scholarship examination. By clicking "I Accept" (where this option is made available), completing the account registration process, or continuing to use the Site, you acknowledge that you have read, understood, and unconditionally agreed to be bound by all terms, conditions, and notices contained herein. If you do not agree to these terms, you must immediately cease using the Site and are prohibited from accessing any of our testing frameworks or services.

    1. Definitions

    Unless explicitly stated otherwise, capitalized terms deployed throughout this Agreement shall carry the distinct meanings outlined below:

    • Account: The verified personal dashboard profile constructed on the Site by a User in accordance with the registration protocols approved by the Company.
    • Applicable Law: Any statute, law, directive, regulation, ordinance, rule, judgment, notification, circular guideline, or decree issued by a competent municipal, state, or central Government Authority within the territory of India holding jurisdictional scope over the parties or the subject matter of this Agreement.
    • Computer Virus: Any malicious computer instruction, malware, spyware, Trojan horse, worm, time bomb, ransomware, or malicious data program explicitly designed to alter, degrade, compromise, intercept, or adversely affect the execution performance of the Site's hosting infrastructure or a user's local browser interface.
    • Confidential Information: All structural data, proprietary algorithms, website source code, software architecture, specialized AI proctoring parameters, digital question banks, test evaluation methodologies, corporate financial details, pricing metrics, and security frameworks owned by the Company that do not reside within the public domain.
    • Content: Any text, graphics, question sets, mock papers, interface layouts, videos, illustrations, assessment guidelines, and multimedia materials published, delivered, or displayed on the Site by the Company.
    • Government Authority: Any local, state, or central government agency, court, tribunal, board, regulatory body, or administrative instrumentality in India holding competent legal jurisdiction over the operations of the Company or the execution of this Agreement.
    • Information Technology Act: The Indian Information Technology Act, 2000, along with its subsequent revisions, amendments, and subordinate statutory rules.
    • Intellectual Property Rights: All right, title, and interest anywhere in the world under common law or statutory frameworks—including patents, trademark registrations, service marks, copyrights, design tools, evaluation scripts, database rights, and proprietary conceptual methodologies—whether negotiable or not, owned by or licensed to ScholarsEdge.
    • Registration Data: The specific information provided by the User during initial account creation or exam enrollment, including but not limited to legal name, email address, mobile phone number, physical address, PIN code, current academic class, school name, and institutional educational board.
    • Prohibited Conduct: Any user activity that violates this Agreement, breaks Applicable Law, compromises the integrity of the examination environment, or infringes upon the intellectual property and operating rights of the Company or other platform participants.
    • Submissions: Any written text, solution scripts, typed or scanned answers, rough sheet images, reviews, or other materials uploaded, inputted, or submitted to the Site by a User during an assessment or via communication channels.

    2. Interpretation

    Unless contextually dictated otherwise:

    • References to any legal statute, act, rule, or regulation include all subsequent modifications, re-enactment updates, and subordinate legislative amendments passed by competent authorities over time.
    • The singular form includes the plural and vice versa; terms importing one specific gender apply equally to all genders.
    • The terms "includes", "including", and "such as" are illustrative and shall not be construed as limits on the generality of any preceding words.
    • Section titles, clause headers, and bold sub-headings are incorporated strictly for reading convenience and do not alter or restrict the legal construction of clauses.

    3. Revisions and Modifications of the Terms

    The Company reserves the absolute right to change, update, append, or modify the terms, conditions, fees, and notices under which the Site and its Services are offered, including but not limited to the charges associated with the use of the platform.

    • Such modified terms shall be effective immediately upon being posted on this webpage.
    • It is your exclusive responsibility to check and review these Terms and Conditions from time to time to ensure you remain aware of any updates.
    • Your continued, uninterrupted usage of the Services and the Site following a posted amendment shall be deemed as your unequivocal acknowledgment and binding acceptance of the modified Agreement.

    4. Service Eligibility and Account Multiplicity

    By registering for an account or subscribing to our Services, the User represents and warrants that they:

    1. Have full power, capacity, and authority to enter into this Agreement and that doing so will not violate any secondary contractual agreement to which they are a party.
    2. Have not been previously suspended, disqualified, or removed from the ScholarsEdge platform for integrity violations or breach of terms.
    3. Are not a direct commercial competitor of ScholarsEdge, and are not accessing the Site or its assets for corporate espionage, duplication, or competitive product development.
    4. Do not maintain more than one active verified ScholarsEdge Account at any given time.

    Age Eligibility and Verifiable Parental Consent (DPDP Compliant)

    • Data Principal Identification: By registering on the Site, you acknowledge that the primary Data Principal utilizing the examination tools is a minor student under the age of 18.
    • Mandatory Parent/Guardian Execution: A minor student is legally prohibited from entering into this Agreement independently. The registration of an Account, the subscription to any test suite, and the submission of browser permissions (webcam, microphone, geolocation) must be executed strictly by a parent or lawful guardian on behalf of the minor.
    • Verification of Consent: The parent or lawful guardian hereby grants irrevocable, verifiable consent for ScholarsEdge to process the minor student's registration metrics, proctoring media, and uploaded answer sheets solely for the execution of the scholarship examinations.
    • Accountability: The authorizing parent or guardian accepts absolute liability for the student's adherence to the exam proctoring guidelines and assumes full financial and legal responsibility for all actions taken through the Account.

    5. Account Registration and Secure Passwords

    • Account Creation: To access mock tests, view custom performance metrics, or sit for live scholarship examinations, a User must fill out the required registration forms and establish a verified Account.
    • OTP Verification: The Company verifies each profile by sending a One-Time Password (OTP) to the mobile number provided. A single mobile number cannot be mapped to multiple profiles.
    • Password Safekeeping: You are entirely responsible for maintaining the confidentiality and secure possession of your dashboard password and account authentication tokens. You are strictly prohibited from transferring, selling, trading, or sharing your Account credentials with any other party.
    • Liability Exclusion: You are solely liable for all academic testing activities, solution inputs, or monetary transactions executed through your Account. ScholarsEdge shall not be held liable for profile tampering, score alterations, or data leaks resulting from third-party hacking if the exposure was triggered by shared credentials or user negligence.
    • Breach Reporting: You must immediately report any incident of account breach, unauthorized login, or suspected security leak to [email protected]. Upon verification, the Company will freeze or suspend the compromised account to secure user data.

    6. Scope of Services and Communication Track Limitations

    A. Online Examination and Mock Suites

    ScholarsEdge provides a web-only interface enabling users to sit for online examinations, continuous mock assessments, and practice evaluation tools. The operational specifics, duration, marking schemes, and award tiers are detailed on individual test landing pages and are governed by this master Agreement.

    B. Transactional Alerts and SMS Service

    The Company may distribute real-time alerts, system confirmations, examination time-tables, score releases, and administrative updates to the User via email, SMS, or WhatsApp channels.

    • Profile Maintenance: In the event of a change in your personal contact number or email, you agree to update your dashboard profile parameters immediately to prevent critical updates from misrouting.
    • Delivery Disclaimer: You acknowledge that system updates forwarded via cellular telecom paths are subject to external transmission dependencies. The Company is not responsible for text messages that are delayed, dropped, or failed due to communication breakdowns within the telecom operator's network.

    C. Contextual Advertising

    The Site may display educational banners, third-party informational links, or promotional space for external academic tools or partner institutions.

    • No Endorsement: ScholarsEdge does not pre-screen, endorse, or guarantee the claims, accuracy, structural validity, or safety of third-party products, applications, or external resources.
    • Exclusion of Claim: Your interactions, commercial dealings, or enrollment choices with third-party providers discovered on or through our Site are solely between you and the respective provider. ScholarsEdge disclaims all liability for commercial losses, data exposures, or individual damages resulting from your engagement with external platforms.

    7. Enrollment Fees, Payments, and Refund Policies

    • Payment Gateways: All fee collections, registration charges, and test suite subscriptions are processed through certified, external, integrated Payment Gateway networks. The Company does not hold, review, or store credit card numbers, CVVs, expiration dates, or net-banking credentials on its servers. Financial processing failures or transaction drops must be resolved directly through your banking institution and the gateway processor.
    • Absolute Non-Refundable Policy: All enrollment fees, registration charges, and testing subscription payments are strictly non-refundable, non-transferable, and non-creditable, regardless of candidate absenteeism, localized hardware issues, or scheduling conflicts, unless explicitly stated otherwise under a separate, time-stamped event policy page on the Site.
    • Fee Modifications: ScholarsEdge reserves the right to modify its enrollment pricing structures, test fees, or subscription packages at its sole discretion without prior notice.

    8. Absolute Academic Integrity and Web-Proctoring Rules

    By registering for an assessment or starting an examination on ScholarsEdge, you explicitly covenant to participate in complete good faith and adhere strictly to the following Web-Proctoring and Academic Integrity Rules:

    • Browser Isolation (Tab/Window Locking): Once an active examination session initiates, the platform locks and monitors your browser focus. Any attempt to minimize the test window, open secondary browser tabs, launch search queries, trigger window switches, or access background desktop applications will be flagged by our security scripts. Multiple system alerts will trigger automatic test termination, session locking, and permanent candidate disqualification.
    • Webcam and Visual Monitoring: The User must grant the browser webcam permissions and ensure the lens remains active, uncovered, and unobstructed throughout the test runtime. Moving out of the camera's viewport, blocking the lens, manipulating room lighting, or allowing any secondary individual to enter the frame constitutes a severe breach of exam integrity and will result in immediate disqualification.
    • Microphone and Audio Monitoring: Ambient acoustic loops are captured via the browser to monitor for external assistance, secondary device usage, or verbal lookup commands. Extraneous whispering, audible prompts, or structural noise anomalies will flag the exam session for manual administrative auditing and potential cancellation.
    • Content Protection and Copy Restrictions: Any attempt to capture screenshots, record screen video streams, copy exam question text, or utilize secondary mobile hardware to record exam content is strictly prohibited. Violating this rule will result in the immediate deletion of your Account, forfeiture of all historical merit rankings, and potential legal action under the Information Technology Act.

    9. Handling of Submissions and Question Banks

    • User Ownership of Submissions: ScholarsEdge does not claim ownership over the scanned answer copies, handwritten essay pages, rough sheets, or solution scripts that you upload or submit to the platform during an assessment window.
    • License Granted to the Company: By uploading or submitting any Submission to the Site, you grant the Company a non-exclusive, worldwide, royalty-free, perpetual license to process, store, host, and transmit those files for the exclusive purpose of evaluating your examination performance, calculating scores, managing merit pools, and verifying exam integrity.
    • Confidentiality of Platform Assets: Conversely, all digital question banks, mock answer sheets, structural explanations, and custom learning materials provided by the Company are strictly confidential. The Company does not distribute or share its underlying proprietary question banks or technical evaluation frameworks with any outside individual or organization.
    • Submission Warranties: You represent and warrant that you own or control all necessary rights to the Submissions you upload, and that your submissions do not violate the intellectual property rights or privacy settings of any third party.

    10. General Conditions: Lawful and Permitted Use

    As an explicit condition governing your permitted use of the Site, you warrant to ScholarsEdge that you will not use the platform for any purpose that is unlawful, tortious, or prohibited by this Agreement.

    • System Integrity Protection: You are prohibited from using the Site in any manner that could damage, disable, overburden, drop, or impair our server infrastructure, or interfere with any other party's legitimate use and enjoyment of the Services.
    • Extraction Restrictions: You may not harvest, extract, mine, or download any materials, content, or technical information through any backdoor channels, automated scraping bots, web spiders, or code sequences not intentionally made accessible to the public by the Company.
    • Information Disclosure: The Company reserves the right at all times to access, monitor, edit, or disclose any user data, system log, or submission file as necessary to satisfy any applicable law, regulation, valid legal process, or Government Authority mandate, or to refuse to post or remove any file in whole or in part at its sole discretion.

    11. Liability Disclaimer and "As-Is" Provision

    • Technical Accuracy Limitations: The information, software, products, graphics, and services included in or made available through the Site may contain technical inaccuracies, structural omissions, or typographical errors. The Company regularly injects updates, upgrades, and structural improvements to the content and infrastructure herein.
    • Professional Consultation Advice: Academic suggestions, sample mock feedback, predictive career analytics, or scholarship pointers received via the Site should be treated as generalized guidelines. They do not constitute formal legal, career, financial, or medical advice, and you should consult a qualified professional for specific advice tailored to your personal context.
    • Absolute "As-Is" Warranty Exclusion: To the maximum extent permitted by Applicable Law, all Content, software scripts, testing engines, graphics, and services are provided "AS IS" and "AS AVAILABLE" without warranty or condition of any kind. ScholarsEdge and its infrastructure suppliers hereby disclaim all warranties and conditions with respect to this information, software, and services, including all implied warranties of merchantability, fitness for a particular purpose, academic title, accuracy, system uptime, and non-infringement.

    12. Total Aggregate Limitation of Liability

    To the maximum extent permitted by Applicable Law, in no event shall ScholarsEdge, its directors, officers, operational employees, affiliates, or technical partners be liable for any direct, indirect, punitive, incidental, special, exemplary, or consequential damages whatsoever—including, without limitation, damages for loss of use, data corruption, profit losses, lost academic opportunities, system failures, hardware damage, or service interruptions—arising out of or in any way connected with:

    1. The use, execution, or performance of the Site or its testing engines.
    2. The localized latency, delay, or temporary inability to use the Site or its related services.
    3. The unauthorized interception or alteration of your data transmissions or profile records.
    4. Technical errors, proctoring software bugs, scoring calculation delays, or localized internet drops.

    Exclusive Remedy: Because some jurisdictions do not allow the total exclusion or limitation of liability for consequential or incidental damages, portions of the above limit may not apply to you. If you are dissatisfied with any section of this testing interface, or with any clause of this Agreement, your sole and exclusive remedy is to immediately discontinue using the Site. Subject to the exclusions above, the total aggregate legal liability of ScholarsEdge under this Agreement for any proven claim or technical lapse shall not exceed the exact fee amount paid by the User to enroll in the specific examination during which the liability arose.

    13. Comprehensive Legal Indemnity

    The User (alongside their parent or legal guardian) agrees to fully defend, indemnify, protect, and hold harmless ScholarsEdge, its directors, founding team, systems engineers, and operational representatives against any and all financial losses, operational costs, liability expenses, claims, lawsuits, administrative penalties, and damages (including reasonable attorney fees and advocate charges) resulting directly or indirectly from:

    • Your breach of any structural clause, integrity standard, or proctoring guideline contained within this Agreement.
    • Your unauthorized publication or transmission of the Company's proprietary Intellectual Property.
    • Third-party intellectual property infringement claims arising from Submissions you upload to the Site.
    • Your violation of any Applicable Law or the rights of another User.
    • Any fraudulent, deceitful, or manipulative action committed via your Account during an active scholarship exam or mock evaluation cycle.

    This indemnification covenant extends to cover all out-of-court settlements, judicial procedures, and legal fees incurred by the Company, even if the underlying dispute is never subjected to formal judicial scrutiny.

    14. Intellectual Property and Copyright Safeguards

    • Platform Ownership: All assets residing on the Site—including website text, graphics, specialized logos, interactive question sets, code modules, proctoring evaluation scripts, database compilations, and interface styling—are the exclusive property of ScholarsEdge and are protected under Indian copyright, trademark, and intellectual property laws. All rights are reserved solely by the Company.
    • Limited License: Users are granted a highly restrictive, personal, non-exclusive, revocable, non-transferable license to access the interface and take examinations for personal, non-commercial educational use.
    • Infringement Prohibitions: You are strictly forbidden from copying, reproducing, republishing, framing, mirroring, selling, licensing, or reverse-engineering any portion of our platform or Content. You may not use our material to launch a competitive testing product or use our question pool for commercial coaching ventures. Any trademarked names or product emblems belonging to third parties displayed on the Site remain the property of their respective owners.

    15. Operational Hazards and Server Protection Controls

    • Bug Defense Efforts: ScholarsEdge implements modern cyber-defense tools, technical firewalls, and data backups to keep its examination platforms secure and functional. However, the Company does not warrant that the website or its host architecture will remain completely free from operational hazards, cyber-attacks, or Computer Viruses.
    • Technical Liability Exclusion: The Company shall not be held liable for system crashes, page lag, processing errors, or data modifications caused by external network faults, user-side hardware compatibility drops, localized browser crashes, electrical blackouts, or telecom routing loops.
    • Rescheduling Provisions: In the rare event of a validated system-wide server outage on our end that interrupts a live examination, the Company will coordinate in good faith to reset and reschedule the impacted test window for the affected candidates.

    16. Data Principal Rights under DPDP Act

    As the parent or lawful guardian of the Data Principal (the minor student), you retain full statutory controls over the student's personal data under Indian data protection laws, which can be exercised by contacting us at [email protected]:

    • Right to Summary: The right to receive a concise summary of the student's personal data being processed and the specific processing activities undertaken by our platform.
    • Right to Correction and Erasure: The right to correct inaccuracies, complete missing information, or request the permanent erasure of the student's account and proctoring history (subject to the completion of active score audit windows).
    • Right to Grievance Redressal: The right to register a formal complaint with our Grievance Desk regarding any perceived data handling discrepancy before escalating the matter to external regulatory boards.

    17. User Grievance Redressal Mechanism

    In compliance with the Information Technology Act, 2000, and the data protection rules established thereunder, any structural disputes, data discrepancies, security tracking bugs, or operational grievances concerning the platform can be filed with our designated Grievance Review Desk:

    18. Waiver and Severability

    • No Implicit Waivers: No failure, delay, or omission on the part of ScholarsEdge in enforcing any right or executing any remedy under this Agreement shall operate as a legal waiver of that or any secondary right.
    • Severability Protocol: If any specific section, clause, sentence, or term of this Agreement is declared invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not impact the validity or enforceability of the remaining sections of this document. The invalid provision shall be construed and modified to reasonably reflect the initial operational intention of the Company while maintaining compliance with Applicable Law.

    19. Entire Agreement

    Unless explicitly stated otherwise herein, this document constitutes the entire contract between the User and ScholarsEdge regarding the management, use, and security of the Site and its Services. It completely supersedes and replaces all prior or contemporaneous communications, proposals, web terms, or verbal understandings between the user and the Company. A printed version of this contract and of any notification dispatched in electronic format shall be fully admissible in judicial or administrative trials to the same extent as other standard printed business documents.

    20. Governing Law and Competent Jurisdiction

    This Agreement, its structural validity, and all performance actions emerging out of your use of our scholarship Services shall be governed by and construed in total alignment with the laws of India.

    In the event of any action, claim, dispute, or legal interpretation arising out of or in connection with these terms, you hereby provide your explicit consent to the exclusive territorial jurisdiction and venue of the competent courts located in Delhi, India, to oversee and settle all such legal disputes.
